On December 24th, 2021, the 32nd meeting of the Standing Committee of the 13th National People's Congress of the People's Republic of China revised and passed the Law of the People's Republic of China on Science and Technology Progress. Among them, Article 91 is clear:

"For scientific and technological innovation products and services organized by natural persons, legal persons and unincorporated organizations in China, government procurement should be purchased under the condition that the function, quality and other indicators can meet the demand of government procurement; For the first time entry into the market, government procurement should take the lead in purchasing, and shall not be restricted on the grounds of commercial performance.

If the products purchased by the government need to be researched and developed, they shall be implemented by ordering. The purchaser shall give priority to selecting scientific and technological research and development institutions, institutions of higher learning or enterprises for research and development by competitive means, and purchase the products according to the agreement after the products are qualified. "


The Order of the President of the People's Republic of China (No.103rd) is issued for the abovementioned implementation.
